Terms and conditions

Terms for using the FairwayX website and current marketplace features. Accounts, buying, selling and messaging are for people aged 18 or older.

Version 1.0 · Updated

1. Who operates FairwayX

FairwayX is operated by John Rawlings, a sole trader trading as FairwayX. Correspondence address: 27 Trouville Road, Liverpool, L4 7UB, United Kingdom. Email: support@fairwayx.co.uk.

These terms describe the current UK-focused golf-equipment marketplace and its supporting website. It does not introduce online checkout, buyer protection or payment-processing terms for features that have not launched.

2. What the current service provides

The website provides information about FairwayX. The app allows users to browse equipment, publish listings, save favourites, exchange messages and manage offers and counteroffers. Listings are provided by individual sellers; FairwayX does not own or inspect the equipment merely because it appears in the marketplace.

Sellers are responsible for their listings and any sale they agree with a buyer. FairwayX remains responsible for its own service and for obligations that the law places on it. Nothing in these terms transfers those obligations to users.

3. Accounts and safe use

Provide accurate information, keep your password secure and use an account you are authorised to control. Contact support if you believe your account has been misused. Do not impersonate another person or attempt to access information that is not intended for you.

You must be at least 18 years old to create or hold a FairwayX account, buy, sell or use marketplace messaging. Public listings and website information may be browsed without an account. Both private individuals and business sellers may use the marketplace. If you act for a business, you must have authority to do so and make your business status clear.

4. Seller responsibilities and listing standards

Only list golf equipment you own or are authorised to sell. Describe the equipment honestly, including its condition, known damage, price and delivery or collection options. Use photos and descriptions you have the right to publish. Do not list stolen, counterfeit, illegal or misrepresented goods.

Keep availability accurate, answer reasonable questions truthfully and make delivery costs and arrangements clear before a buyer commits. Do not disclose another person’s private contact details in a public listing. Business sellers must clearly identify themselves as traders and must not present themselves as private individuals. They must provide buyers with the business identity, contact details, pricing, delivery, cancellation and returns information required by law before a purchase is agreed. A private profile field does not by itself provide that information to a buyer.

5. Additional rules for business sellers

Before a buyer agrees to buy, disclose your legal and trading name, geographical business address, email and any other legally required contact details. Give a separate complaints or returns address if applicable. Companies must provide their required registration and registered-office details; VAT-registered sellers must give their VAT number where required. Do not describe yourself as verified merely because you have ticked a declaration.

Provide accurate item details, the total price including applicable taxes, delivery charges, payment and delivery arrangements, and applicable cancellation, return and complaint information. Where a statutory cancellation right applies, provide the required model cancellation form and a confirmation the buyer can retain. These duties apply before a binding agreement, including one made in messages; they do not wait for FairwayX checkout to launch.

For ordinary business-to-consumer distance sales of goods, consumers normally have 14 days after receipt to notify cancellation and a further 14 days to return the goods, subject to legal exceptions. Explain who pays return postage before the sale and refund standard outbound delivery where required. Cancellation rights are separate from rights concerning faulty or misdescribed goods. A seller’s own policy cannot reduce statutory rights.

6. Buyer responsibilities

Read the listing and photographs, ask about anything unclear, and confirm condition, price and fulfilment arrangements with the seller. Provide accurate information needed for any agreed delivery or collection. Do not misuse offers or messages to harass another user or misrepresent your intentions.

7. Offers, payments and buyer protection

Offers and counteroffers record the parties’ negotiations. Accepting an offer does not charge a card, create a paid order or transfer money through FairwayX. Whether the parties have separately made a binding agreement depends on what they agree and the applicable law; a payment-free app action is not a guarantee that no contract can exist.

Online checkout, payment collection, shipping labels, delivery tracking and FairwayX buyer protection are not operational. FairwayX currently provides no escrow, insurance or promise to reimburse a purchase. Do not treat a planned protection feature as active coverage. Any future charges, payment arrangements and protection rules will be explained separately before launch.

8. Delivery, collection and item problems

The seller and buyer must agree whether equipment will be delivered or collected, who arranges delivery, the cost and the relevant timing. FairwayX does not currently book couriers or provide a tracking service.

If an item is missing or differs from its description, contact the seller promptly and keep the listing and relevant correspondence. Rights and remedies depend on the circumstances, including whether a seller is acting privately or as a business. Consumers buying online from business sellers may have statutory cancellation and refund rights, subject to applicable exceptions. Business sellers must honour applicable rights concerning faulty, misdescribed or otherwise non-conforming goods. Private sales have different protections. These terms do not remove statutory consumer rights or permit a trader to avoid its legal obligations.

9. Content and prohibited conduct

Use FairwayX lawfully and respectfully. Do not publish fraudulent, threatening, discriminatory or unlawful content; send spam; interfere with the service; or attempt to bypass access controls. Only share content and personal information you are entitled to use.

You retain ownership of your own photos and text. By submitting listing or message content, you permit FairwayX to store and display it as needed to provide the feature you request, subject to the Privacy Policy and applicable rights. This does not give FairwayX a general right to use your content for unrelated advertising.

10. Account deletion and service issues

You can request deletion using the app’s account settings or contact support for assistance. Background cleanup and limited retention of other participants’ records are explained in the Privacy Policy. Deleting an account does not automatically resolve an existing dispute or erase copies another person independently holds.

Service interruptions may occur during maintenance or due to faults. Contact support about a service problem or suspected abuse. We will consider the circumstances and any legal obligations when responding; these terms do not promise an automated moderation or dispute-resolution process that has not been implemented.

11. Responsibility and your legal rights

FairwayX is responsible for providing its own service with the standard of care required by law. Seller-provided descriptions are not a separate guarantee by FairwayX, but that does not exclude any responsibility FairwayX itself has under applicable law.

Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded. Nothing removes mandatory consumer protections.

12. Applicable law

These terms are governed by the law of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections available under the law that would otherwise apply. You may bring proceedings in any court available to you under applicable consumer jurisdiction rules, including the courts where you live where the law permits.

13. Complaints and updates

Send service complaints to support@fairwayx.co.uk with your username, relevant listing details and a description of the problem. Please do not send passwords or full payment-card details. A complaint about an item should also be raised with the seller. Contacting FairwayX does not prevent you exercising legal rights elsewhere.

Changes to the service or these terms will be described clearly with a revision date. Future payment or protection features will need their own applicable conditions before use. Updated wording will not retrospectively remove rights that have already arisen. Changes affecting existing accounts will be communicated before they take effect where required; publishing revised wording does not by itself record your agreement.
